Agreement to Terms

By accessing and using the American Samoa Digital Traveler Declaration system, you agree to be bound by these Terms of Use and all applicable laws and regulations of the American Samoa Government and the United States of America. If you do not agree with any of these terms, you are prohibited from using this service.

Official Government Service

This is an official digital service of the American Samoa Government, operated in partnership with Immigration, Treasury-Customs Division, Department of Agriculture - Quarantine Division, and other government agencies. This is the only authorized platform for submitting digital traveler declarations for entry into, departure from, or transit through American Samoa.

User Responsibilities

When using this service, you agree to:

• Provide Accurate Information: Submit truthful and complete information in all declaration forms exactly as it appears on your passport or Certificate of Identity (CI). False or misleading declarations may result in legal penalties, denial of entry, or deportation.
• Comply with Laws: Adhere to all applicable immigration, customs, biosecurity, and other laws of American Samoa and the United States.
• Declare Required Items: Accurately declare all items that require declaration. If you're unsure about any item, declare it anyway. Declaring doesn't always mean it's prohibited—it helps Customs, Immigration, and Agriculture protect American Samoa and process you faster.
• Protect Your Credentials: Safeguard your confirmation number and e-Declaration. You are responsible for any submissions made with your credentials.
• Submit Timely Declarations: Complete your declaration prior to arrival, departure, or transit as required by regulations.
• Update Information: If plans change (delay, diversion, flight change), use the Retrieve e-Declaration feature to update your details promptly.

What You Must Declare

You are required by law to declare certain items. Honesty in reporting helps protect American Samoa's environment, agriculture, and public health. It also helps avoid processing delays, penalties, and/or possible imprisonment.

Plants & Agricultural Items

• Fresh fruit and vegetables
• Rooted plants, plant cuttings, algae, or seaweed products
• Soil, sand, growing media, compost, or items contaminated with soil
• Cultures of bacteria, fungi, viruses, or protozoa
• Cut flowers and foliage
• Seeds or bulbs (raw or for planting)
• Live or dead seafood (lobsters, crabs, clams, sea cucumbers, etc.)
• Meat & animal products (fresh, frozen, dried, smoked, cooked; sausages/jerky/cured meats; packaged foods containing meat)
• Insects; live fish; amphibians; or similar organisms
• Clothing, shoes, hiking gear, camping gear, or equipment exposed to farms, animals, soil, or similar environments

Animals

• Dogs, cats, birds, reptiles (turtles, lizards, snakes)
• Animal parts or animal byproducts (declare if unsure)

Currency & Commercial Goods

• Currency or monetary instruments over USD $10,000 (or foreign equivalent)
• Goods/samples for business, commercial, or trade use, or goods carried on behalf of another person
• Goods obtained overseas or purchased duty-free with a combined total of USD $500 or more (including gifts)
• Tobacco products over personal allowance: 200 cigarettes, 100 cigars, or 2 kg of tobacco products per adult (21 years and over)
• Alcoholic beverages over personal allowance: more than 1 liter per adult (21 years and over)

Restricted or Controlled Items

• Firearms, ammunition, or explosives
• Controlled substances or illegal drugs
• Prescription medications (if carrying three (3) or more months supply)
• Counterfeit goods or pirated media that infringe on trademarks/copyright
• Protected wildlife products, shells/coral, or other regulated natural items
• Hazardous chemicals or toxins
• Any item requiring a permit, license, or prior approval from the American Samoa Government
• Any other restricted, prohibited, or regulated items

Permit Requirements

Some travelers must have a valid permit or entry authorization to enter or remain in American Samoa:

• Foreign Nationals: Anyone who is not a native-born American Samoan or a U.S. citizen is required to have a Permit Number. This permit allows them to reside in American Samoa and must be renewed annually to maintain permanent resident status.
• Visitors from Non-Waiver Countries: People visiting from countries that are not part of the American Samoa Visa Waiver Program are required to obtain a permit before traveling to American Samoa.

Prohibited Activities

You are prohibited from:

• Submitting false, fraudulent, or misleading information
• Impersonating another person or submitting declarations on behalf of others without proper authorization
• Attempting to circumvent, disable, or interfere with security features
• Using automated systems, bots, or scripts to access the service
• Attempting to gain unauthorized access to our systems or data
• Reproducing, distributing, or creating derivative works of this service
• Using this service for any unlawful purpose

Legal Consequences of False Declarations

I declare that the information given is true, correct and complete. I understand that failure to answer any questions may have serious consequences. Providing false or incomplete information on your traveler declaration may result in:

• Criminal prosecution under American Samoa and U.S. federal law
• Civil penalties and fines
• Denial of entry into American Samoa
• Deportation or removal proceedings
• Seizure of undeclared goods or currency
• Future visa or entry restrictions
• Other legal actions as permitted by law

e-Declaration Terms

Upon successful submission of your declaration, you will receive an e-Declaration confirmation. Please note:

• The e-Declaration is a confirmation of submission only and does not guarantee entry into American Samoa
• You must present your e-Declaration (digital or printed) upon arrival
• Your declaration will be verified against your travel document at arrival, departure, or during transit processing, depending on your travel type
• Immigration and customs officers retain full authority to conduct additional inspections and make final entry decisions
• The e-Declaration is valid only for the travel dates specified
• You must submit a new declaration for each trip to American Samoa

Service Availability

We strive to maintain continuous availability of this service. However, we reserve the right to modify, suspend, or discontinue the service at any time without notice. We are not liable for any inconvenience or loss resulting from service interruptions, technical issues, or maintenance periods. We recommend submitting your declaration well in advance of your travel date to account for any potential service issues.

Intellectual Property

All content, design, graphics, logos, and software associated with this service are the property of the American Samoa Government or its licensors and are protected by applicable intellectual property laws. The American Samoa Government seal and official emblems may not be used without express written permission.

Disclaimer of Warranties

This service is provided "as is" and "as available" without any warranties of any kind, either express or implied. The American Samoa Government does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that any errors will be corrected or that the service will meet your specific requirements.

Limitation of Liability

To the fullest extent permitted by law, the American Samoa Government, its agencies, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use this service, including but not limited to missed flights, denied entry, or any other travel-related losses.

Indemnification

You agree to indemnify, defend, and hold harmless the American Samoa Government, its agencies, officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from your use of this service, your violation of these Terms of Use, or your violation of any rights of another.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of American Samoa and the United States of America. Any disputes arising from these terms or your use of this service shall be subject to the exclusive jurisdiction of the courts of American Samoa.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to this page. Your continued use of the service after any changes constitutes your acceptance of the new terms. We encourage you to review these terms periodically.

Severability

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
